Eventuali violazioni del codice etico commesse da Dipendenti costituiranno inadempimento alle obbligazioni derivanti dal rapporto di lavoro e illecito disciplinare, e saranno sanzionate come tali, nel rispetto delle disposizioni della legge e del Contratto Collettivo Nazionale di Lavoro applicabile, con ogni conseguenza di legge, anche in ordine alla conservazione del rapporto di lavoro (e ciò indipendentemente dall’eventuale rilevanza penale dei comportamenti tenuti e/o dall’instaurazione di un procedimento penale, ove ricorra un reato).

Qualora la violazione del codice etico sia posta in essere da un Collaboratore, tale comportamento sarà sanzionato in conformità a quanto previsto dalle relative pattuizioni contrattuali, ad esempio attraverso la risoluzione del contratto.

I Destinatari non utilizzano a fini personali informazioni, beni e attrezzature di cui dispongano nello svolgimento della funzione o dell'incarico.

I Destinatari sono tenuti a rispettare con diligenza le leggi vigenti, il Codice ed i regolamenti interni. In nessun caso il perseguimento dell'interesse di ebilling S.p.A. può giustificare una condotta non onesta e non conforme alla vigente normativa.

I Dipendenti di ebilling S.p.A. devono astenersi dallo svolgere attività di concorrenza con quelle di quest'ultima, rispettare le regole aziendali ed attenersi ai precetti del presente Codice, la cui osservanza è richiesta anche ai sensi e per gli effetti di cui all'art. 2104* del codice civile.

Articolo 10 : Rapporti con le istituzioni

I rapporti di ebilling S.p.A. e dei Destinatari nei confronti delle istituzioni pubbliche locali, nazionali, comunitarie e internazionali ("Istituzioni"), nonché nei confronti di pubblici ufficiali o incaricati di pubblico servizio, ovvero organi, rappresentanti, mandatari, esponenti, membri, dipendenti, consulenti, incaricati di pubbliche funzioni, di pubbliche istituzioni, di pubbliche amministrazioni, di enti pubblici, anche economici, di enti o società pubbliche di carattere locale, nazionale o internazionale ("Pubblici Funzionari") sono intrattenuti da ciascun Amministratore e da ciascun Dipendente, quale che sia la funzione o l'incarico, o, se del caso, da ciascun Collaboratore, nel rispetto della normativa vigente e sulla base dei principi generali di correttezza e di lealtà.

Nel caso specifico dell'effettuazione di una gara con la Pubblica Amministrazione, ebilling S.p.A. ed i Destinatari dovranno operare nel rispetto della legge e della corretta pratica commerciale.

Articolo 13 : Acceptable use policy dei sistemi informativi aziendali

Article 1 : Sphere of applications and Recipients

Any infringements of the ethic commitment by Employees shall represent the non-fulfilment of the obligations relating to their employment and shall be considered as irregular behaviour and as such they shall be subject to the sanctions laid down by the law and the Collective National Labour Contract, with all legal consequences, including the discontinuation of the employment (and this quite apart from the penal importance of the behaviour in question and/or the starting of criminal proceedings in the event of an offence having been committed).

The Recipients shall not use information, goods and equipment of which they avail themselves during the performance of their duties or the appointment for personal purposes.

The Recipients shall diligently observe applicable laws, the Ethic Commitment and internal regulations. Under no circumstances shall the pursuit of ebilling S.p.A. interests justify dishonest conduct or conduct not in conformity with applicable rules.

Employees shall abstain from performing activities in competition with those of ebilling S.p.A. and shall observe company rules and comply with the principles of this Commitment, the observance of which is also required pursuant to and by effect of art. 2104* of the Italian Civil Code.

The documents certifying accountancy recording activities must be such as to ensure prompt reconstruction of accountancy operations, the finding of any errors, and the degree of responsibility within the single operating process.

Article 13 : Acceptable use policy of company information systems

The gradual spreading of new information technologies and, especially, free access to the Internet on the part of Personal Computers, exposes eBilling to the risks of both patrimonial and penal involvement, creating problems for Company security and image. Considering therefore that the use of the Company?s information technology and telematic resources must always be inspired by the principle of diligence and correctness ? behaviours normally adopted in a work relationship - eBilling has adopted this Acceptable use policy of company information systems " & _

These rules are adopted in compliance with the internal eBilling regulations and the regulations on the protection of personal data (Commitment regarding the protection of personal data approved by Law Decree no. 196/03, subsequently indicated with Law Decree no.196/03).

It should be remembered that, generally speaking, complying with the provisions regarding the protection of personal data indicated in the letter of appointment of the Person charged with data processing pursuant to Law Decree no. 196/03 is mandatory.
